It applies to every page, tool, form, and inquiry on the site, and it is issued by Loancutters, Inc. dba Evoque Lending, including its Evoque Commercial platform ("Evoque").

The pages, programs, guides, calculators, articles, and examples on this website are informational. None of them is an offer to lend or arrange financing, an approval, a prequalification, a term sheet, or a commitment of any kind, from Evoque or from any capital source. Descriptions of financing categories describe kinds of work, not available transactions.
Submitting information is not an application or a commitment
Submitting an inquiry, a project review request, documents, or any other information through this website, or by email or phone, is not a loan application, does not create an approval or commitment, and does not obligate Evoque to evaluate or pursue the request. It begins a conversation, nothing more. Preliminary feedback, indicative structures, and verbal or written discussions during that conversation are not commitments either, and any of them may change or end as review proceeds.
What a real commitment looks like
A commitment to provide financing exists only when a definitive written agreement (a commitment letter or the final transaction documents) has been issued and executed by the capital provider actually providing the financing, and any conditions in it have been satisfied. Until that point, no party is bound to lend, invest, close, or fund. Because financing arranged through this platform may come from third-party capital sources, that written agreement typically comes from the capital provider, not from Evoque.
Underwriting, due diligence, and conditions
Every financing is subject to underwriting; to approval of both the property and the sponsorship; and to due diligence, including third-party reports, title and lien review, and verification of submitted information. Requirements and conditions can be added or revised as review proceeds, and structures discussed early in a file routinely change by closing. No financing is guaranteed. No approval is assured, no particular terms are assured, and no closing or funding date is assured; timelines depend on documentation, third parties, and the capital source, and none of them is within any single party's control.
Why we state it this bluntly
Developers plan construction starts, purchase deadlines, and payoffs around their financing. Treating a conversation, or a page on a website, as a commitment is how projects get hurt. The honest rule is the safe one: until the capital provider's written agreement is executed and its conditions are met, plan as though the financing is not yet done, because it is not.
